Terms of Use

1. About Spotto

Spotto is a children's vocabulary and speech development app developed and operated from Belgium. By downloading or using Spotto you agree to these Terms of Use. If you do not agree, please do not use the app.

2. Who can use Spotto

Spotto is intended for use by young children under the supervision of a parent or legal guardian who is at least 18 years old. By setting up the app you confirm that you are the parent or guardian of the child using it and that you accept these terms on their behalf.

3. Subscription and payment

Spotto offers a free trial period followed by optional paid subscriptions (monthly or annual). All payments are processed through the Apple App Store. Prices are displayed in the app before purchase.

  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period
  • You can manage or cancel your subscription at any time via your Apple ID settings
  • We do not offer refunds beyond what is required by applicable law or Apple's own refund policy
  • Belgian consumer protection law applies where relevant

4. Acceptable use

You agree not to:

  • Use the app for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or tamper with the app
  • Use automated tools to access or overload our servers
  • Circumvent any security, authentication, or subscription mechanisms
  • Use the app in any way that could harm a child

5. Intellectual property

All content in the Spotto app — including the mascot, audio, graphics, game logic, and branding — is owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works from any part of the app without our written permission.

6. Camera and AI features

Spotto uses your device camera and Google's Gemini AI to identify objects and generate spoken feedback. The quality and accuracy of object recognition may vary. Spotto is a learning aid, not a substitute for professional speech therapy. If you have concerns about your child's speech development, please consult a qualified speech-language pathologist.

7. Disclaimer of warranties

The app is provided “as is” without warranties of any kind. We do not guarantee that the app will be error-free, uninterrupted, or that it will produce specific educational outcomes. We make reasonable efforts to maintain service quality but cannot guarantee availability at all times.

8. Limitation of liability

To the maximum extent permitted by Belgian and EU law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim arising from use of Spotto shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Belgian law.

9. Third-party services

Spotto integrates third-party services including Google Gemini, Firebase, and RevenueCat. Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices of these third parties.

10. Changes to the app or terms

We may update these terms or change app features at any time. Material changes to terms will be communicated via an in-app notice. Continued use of the app after changes constitutes acceptance. We may discontinue the app or any feature with reasonable notice where possible.

11. Governing law

These terms are governed by Belgian law. Any disputes will be subject to the jurisdiction of the courts of Belgium. If you are a consumer in the EU, you also benefit from the mandatory consumer protection provisions of your country of residence.
